Terms of Service

These terms govern your use of the Skelly Essentials toolkit and website, operated by Skelly Essentials LLC, a Maryland limited liability company ("we", "us"). By buying Bones or using the toolkit you agree to them. If you don't agree, don't use the service.

1. What the service is

Skelly Essentials is a web application for generating advertising creative — images, video, voiceover audio and written scripts — using third-party AI models. Access is granted to individual accounts and is not transferable.

2. Bones and payment

• Bones are prepaid credits used inside the toolkit. One Bone equals one US cent.
• Bones are sold in packs as a one-time purchase. There is no subscription and nothing renews automatically.
• Bones have no cash value, cannot be exchanged for cash, and are not transferable between accounts.
• Unused Bones do not expire while your account is in good standing.
• The Bone cost of each action is shown before you run it. If a generation fails on our side, the Bones for it are returned to your balance.
• Payments are processed by Polar Software Inc. as merchant of record. Card details are handled by Stripe and never reach our servers.
• Prices are in US dollars. Applicable sales tax or VAT is calculated and collected by Polar at checkout.

3. Refunds

Refunds are governed by our Refund Policy, which forms part of these terms.

4. Your account

• You are responsible for activity under your account and for keeping your sign-in secure.
• One account is for one person or business. Sharing credentials so multiple people can use a single balance is not permitted.
• You must be at least 18, or the age of majority where you live.

5. Acceptable use

You may not use the service to create or distribute:

• Content that infringes someone else's copyright, trademark, or likeness rights.
• Sexual content involving minors, or non-consensual intimate imagery of any person.
• Material that impersonates a real person or organisation in order to deceive.
• Unlawful medical, financial, or health claims, or anything that breaks the advertising rules of the platform you publish on.
• Harassment, hate speech, or content promoting violence.

We may suspend or close an account that breaks these rules. Where we close an account for a breach, unused Bones are not refunded.

6. Your content and what you generate

You keep ownership of the material you upload. As between you and us, you own the output you generate and may use it commercially. You are responsible for checking that your use of an output is lawful in your jurisdiction and complies with the rules of any platform you publish it on.

You grant us a limited licence to store and process your uploads solely to operate the service for you.

7. AI output

Generated output is produced by machine learning models and can be inaccurate, generic, or unintentionally similar to other material. We do not warrant that any output is original, accurate, or fit for a particular purpose. Review anything before you publish or spend money promoting it.

8. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. The service depends on third-party AI providers, and their outages, price changes, or policy changes may affect what is available. We may change or discontinue features with reasonable notice.

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising from your use of the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential losses, including lost profits, lost advertising spend, or lost data.

Nothing in these terms limits liability that cannot be limited by law.

10. Changes

We may update these terms. Material changes will be posted on this page with a new date. Continuing to use the service after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the State of Maryland, USA, without regard to its conflict of law rules.
